Del sujeto ontológico a la agencia funcional: crisis antropocéntrica e imputación en la inteligencia artificial

Resumen

La irrupción de la inteligencia artificial autónoma no solo plantea un desafío regulatorio, sino que precipita una crisis ontológica en los fundamentos del derecho penal moderno. Este trabajo analiza filosóficamente la «brecha de responsabilidad» no como un mero vacío técnico, sino como el síntoma del agotamiento del paradigma antropocéntrico que vincula la imputación a la conciencia y la voluntad metafísica. En diálogo con la dogmática penal continental y la filosofía de la tecnología, se examinan las limitaciones de las categorías tradicionales (culpabilidad, acción) frente a la opacidad algorítmica. Como superación de esta aporía, se fundamenta epistemológicamente la categoría de «agencia penal funcional». El artículo propone transitar desde una metafísica del sujeto hacia una ontología jurídica relacional y sistémica, articulando un modelo de imputación híbrida que, mediante la responsabilidad distribuida, preserve las garantías liberales en un entorno posthumanista.

Abogado, docente en la Facultad de Derecho y Ciencias Políticas de la Universidad Privada del Norte de Perú, posee una Maestría en Gerencia Social por la Pontificia Universidad Católica del Perú (PUCP). Su trabajo académico se centra en bioética, filosofía del derecho, regulación de nuevas tecnologías y economía del comportamiento, áreas en las que desarrolla enfoques interdisciplinarios orientados a analizar las implicancias sociales, éticas y normativas de la innovación científica y tecnológica.
