The Logic of Protection and Repression of Childhood in Brazil in the Twentieth Century: From the Código de Menores to the Estatuto da Criança e do Adolescente

Abstract

This article analyzes the configuration of the Brazilian legal and social context regarding child welfare throughout the twentieth century. It takes as its starting point the repressive treatment applied to abandoned minors, which led to their institutionalization by the State. The study seeks to understand how assistance to abandoned and so-called delinquent children developed under both protective and repressive perspectives during the period examined. Methodologically, the study analyzes the normative instruments in force in Brazil between 1927 and 1990 in order to identify, from a deductive and analytical perspective, how minors lacking family protection, abandoned, or classified as delinquent were socially and legally conceived until they became priority beneficiaries of public policies aimed at ensuring their human rights. It is concluded that in Brazil there was a 63-year legislative gap regarding the structural reform of child protection during the period analyzed, and that only with the enactment of the Estatuto da Criança e do Adolescente did the repressive paradigm of the “minor in an irregular situation” shift to the paradigm of comprehensive protection of children and adolescents as rights-bearing subjects.
