La Directiva 2014/104/ue de acciones por daños al derecho de la competencia: un comentario crítico

Resumen

El 26 de noviembre de 2014 fue aprobada la Directiva 2014/104/ue del Parlamento Europeo y del Consejo, relativa a determinadas normas por las que se rigen las acciones por daños en virtud del Derecho nacional, por infracciones del Derecho de la competencia de los Estados miembros y de la Unión Europea (Directiva 2014/104/ue). Es indudable que, pese a no estar exenta de crítica, esta Directiva constituye un avance fundamental y necesario para el desarrollo y la protección de la aplicación privada del derecho de la competencia (private enforcement). El propósito de este artículo es ofrecer una visión global de las disposiciones de la Directiva 2014/104/ue, analizando los aspectos más problemáticos de la misma, los cambios que acarrea para los principales sistemas jurídicos europeos y su coherencia con el objetivo comunitario de equilibrio entre la acción pública (public enforcement) y el private enforcement.
