Abstract

The regulatory review analyses the new features of Directive (EU) 2024/1385 of the European Parliament and of the Council of 14 May 2024 on combating violence against women and domestic violence. It highlights the most relevant aspects in terms of European harmonisation to identify what gender-based violence is and what implications it has in terms of articulating mechanisms for its eradication. The direct impacts at the domestic level in Spain are discussed, highlighting the regulatory advances of the last 20 years insofar as they represent, in some aspects, more advanced legislation than that regulated at the European level. Likewise, the analysis delves into the challenges for the future both internally (in Spain) and at the level of the rest of the member states from an iusfeminist perspective.
