Legal framework of multimodal transport

Abstract

The legal regime of multimodal transport is not composed by international uniform rules. It is composed by a multitude of national and supranational systems that respond to different legal approaches. In the absence of an international legal framework and despite the activity of private law there have been several governments and intergovernmental bodies who have decided to enact laws in order to solve the problems due to the lack of legal certainty. Thus we find scattered multimodal legislation, at national, international and private level; and with different systems of responsibility, such as the network system, the uniform system and the modified network system. In this article we will make a detailed analysis of the various existing laws and as each of them contemplates the controversial issue of the liability of transport operator.
