Fundamentos históricos del derecho penal y principio de legalidad: de los códigos de la Magna Grecia a las XII Tablas de Roma
Resumen El artículo trata acerca de dos cuestiones sobre las que parece haber amplio consenso en la literatura académica jurídica en general y jurídico-penal en particular: a) el derecho y el pensamiento jurídico occidental comienzan a generarse en la Antigua Roma; b) el principio de legalidad penal tiene sus orígenes en la Ilustración. En ambos casos, por supuesto, los autores no ignoran que hubiera antecedentes remotos, pero, o bien se omite cualquier análisis de ellos, o bien se suelen descartar por una u otra razón. La tesis defendida en este artículo se aparta de esta ortodoxia: se argumenta que ya en las legislaciones primitivas de las colonias griegas occidentales (Magna Grecia) se encuentran elementos que determinan el desarrollo ulterior y el devenir histórico del derecho y, en concreto, del principio de legalidad como pilar del derecho criminal y del Estado de derecho tal y como los conocemos modernamente. La conexión histórica clave es la Ley de las Doce Tablas de Roma. Con objeto de ilustrar las razones que avalen la tesis defendida, al análisis de lo que podemos conocer de aquellos códigos griegos y de su influencia en la protolegislación romana se dedica buena parte del trabajo.
