Trans People, Active and/or Passive Subjects of Femicide?
Abstract In the article, the problem that has the possibility of considering, as active and / or passive subject of femicide (art. 80 inc. 11 of the CP), transgender people will be addressed, for which an interpretation is made that consistent with the gender identity law enacted in Argentina. My conclusion will be that, using the aforementioned law in experiential and subjective terms, regardless of biology, transgender people can be considered as active and/or passive subjects in the crime of femicide, especially when art. 80 inc. 11 of the Penal Code, which defines said crime, the gender identity law was already in force in Argentina, so “man” and “woman” can no longer be defined in biological terms.
